Treatwell Pro Referral Program – Terms and Conditions

Please read these Terms and Conditions carefully before you participate in the Treatwell PRO Referral Program (the “Scheme”) as these will apply. If you do not agree with these Terms and Conditions, you must not participate in the Scheme. Please note that our Terms & Policies as set out at the “Legal” section of our website will continue to apply to your use of our website and Treatwell PRO. The Scheme is promoted and managed by:

    (“Treatwell”).

ELIGIBILITY, SUBMISSION AND RESTRICTIONS

The Scheme is open to eligible Treatwell PRO users (“Referrer”) who “refer a friend” to purchase a Treatwell PRO subscription, subject to the following conditions and restrictions:

  • Referrers must be existing Treatwell Partners with an active Treatwell PRO subscription.
  • Referrers will not be eligible if:
    • their Treatwell PRO subscription is no longer in force for any reason; or
    • the Referrer has provided notice to cancel their Treatwell PRO subscription; or
    • the Referrer is in breach of any of the terms of their Treatwell PRO Agreement.
  • Only the Owner of the Treatwell account (TW Pro & TW Connect) may be a Referrer (or you are an employee of a Partner and have the Owner’s consent to make the referral).
  • Referrers must provide all requested information of the prospective Treatwell Partner (“Referee”) via the online submission form to be eligible (“Referral”). Any entries made other than via the online submission form will not be included.
  • Referrers and Referees must be residents of a country in which Treatwell currently operates at the time of the Referral.
  • Any Referee of which Treatwell is already actively pursuing will not be eligible as a Referral.
  • Any Referrals made by Referrers for Referees for which the Refferer has a legal or beneficial interest in the Referee (whether directly or indirectly) will not be eligible.
  • Any Referee must not: (i) have previously been a Partner who was terminated by Treatwell for a breach of the Partner Terms of Business; or (ii) otherwise be deemed by Treatwell in its sole discretion as ineligible.
  • If numerous Referrals are made for the same Referee only one Referrer will be eligible for that Referral, to be decided at Treatwell’s sole discretion.
  • Referrers and Referees (where applicable) must be aged 18 or over.
  • The Scheme is active from the date it is communicated to a potential Referrer.
  • The Scheme excludes employees, contractors or workers of Treatwell or any Group Company and their immediate families, and anyone professionally connected to the Scheme.
  • The Referrer or Referee may be asked to provide proof of ID.
  • Entries made from trade, consumer groups, third parties, agents, or entries automatically generated by computer will not be accepted.
  • Treatwell reserves the right to withdraw the Scheme (or change these Terms and Conditions) at any time for any reason. Any Referrals made after withdrawal of the Scheme will not be valid.

THE VOUCHER:

  • The Referrer will be eligible to receive an Amazon eGift Voucher (the “Voucher”).
  • The Referrer will only become eligible for a Voucher once the Referee signs a contract for an annual commitment to Treatwell PRO (“Completed Referral”).
  • The Completed Referral must occur within 60 days of the Referral.
  • The Referrer will be eligible to receive 1 (one) Amazon voucher for each Completed Referral.
  • The value of the Voucher provided will be calculated in accordance with the table below based on the amount of staff registered in the Referee’s Treatwell PRO account:

Number of Staff: 0-2 | Voucher Value £/€150

Number of Staff: 3-5 | Voucher Value £/€250

Number of Staff: 6+ | Voucher Value £/€400

  • The Voucher will be for the Amazon marketplace where the Referrer is resident. The Voucher will be in the currency used by the country in which the Referrer is resident (£GBP or €EUR).
  • Use of the Voucher is subject to Amazon’s Terms and Conditions. It is the sole responsibility of the Referrer to comply with these terms.
  • The Voucher may not be redeemed in conjunction with any other offer or scheme.
  • No cash alternative is available.
  • The redemption of the Voucher is subject to availability.
  • Treatwell reserves the right to substitute the Voucher for another of the same value.
  • Treatwell reserves the right to refuse to provide a Voucher if it reasonably believes there has been a breach of these Terms and Conditions or there has been any illegal activity connected with the Scheme.

DELIVERY

  • The Referrer will automatically be sent the Voucher(s) via email within 60 days of a Completed Referral. If the Referrer’s Treatwell PRO subscription is cancelled during this 60 days period the Reffer’s eligibility to receive the Voucher(s) will be voided.
  • The Voucher will only be delivered to the Owner’s email address associated with the Referrer’s Treatwell PRO account. Referrers are responsible for ensuring their email address in Treatwell PRO is kept up to date. Treatwell will not be responsible for non-delivery if the address is incorrect.
  • Treatwell will not be responsible for any undelivered Voucher(s), delays or defects in delivery for any reason, or loss of the Voucher.
  • Treatwell will not be held responsible for any injury, loss or damages resulting from any purchases made using the Voucher.

DATA PROTECTION

If you choose to participate in the Scheme, Treatwell will ask you to submit your: full name, email address, phone number and postal address.

By entering the Scheme and providing the personal information listed above, you agree to receiving communications regarding the Scheme and your Voucher(s) from Treatwell and/or Amazon. Treatwell may need to share your personal information with Amazon in order for your Voucher(s) to be redeemed by you or sent to you directly by Amazon.

You will also be asked to submit the Referee’s: full name, email address, phone number and postal address.
You must ensure you have obtained the Referee’s consent to providing this information to Treatwell and make the Referee aware of these Terms and Conditions. You will be liable to Treatwell for any loss incurred in not complying with these requirements.

The personal information will be collected, processed and used by Treatwell as data controller in accordance with Treatwell’s Privacy & Cookie Policy which can be found here: https://www.treatwell.nl/en/ and selecting the relevant jurisdiction in the bottom right.

All Referrers and Referees have the right to access, modify, rectify and delete data concerning them. The Referrer or Referees may exercise this right by writing to the e-mail address set out at the top of these Terms and Conditions.

LIMITATION OF LIABILITY

Treatwell cannot be held responsible for non-receipt of Referrals due to technical problems or network difficulties. Proof of submission does not constitute proof of delivery. By participating in the Scheme, you agree that you participate at your own risk. Except that Treatwell does not exclude or limit its liability for personal injury or death caused by its negligence or for fraudulent misrepresentation or any other liability that may not, by law, be limited or excluded, Treatwell accepts no liability in relation to an individual’s participation (or inability to participate) in the Scheme to the maximum extent permitted by law, including any direct, indirect, incidental, consequential, or any other type of damages related to or arising from the Scheme or your participation in the Scheme.

SEVERANCE

If any part of these Terms and Conditions is found to be unenforceable as a matter of law, all other parts of these Terms and Conditions shall be unaffected and remain in force.

GOVERNING LAW

The Scheme and these Terms & Conditions will be governed by and construed in accordance with the laws of the country of the relevant Treatwell company. You and we each agree that the courts of that country will have non-exclusive jurisdiction over any claim or dispute arising from, or related to, the Scheme or these Terms and Conditions.
